Deferred Disposition

​​​​Deferred Disposition Eligibility

Deferred Disposition is an option you may be able to request to keep a violation off of your record. Deferred disposition is available for most offenses.

Eligibility Requirements

  • You are not eligible for deferred if you completed deferred disposition within 12 months of the offense, or the offense occurred in a construction zone with workers present, or if you held or currently hold a Commercial Driver's License (CDL) and the offense relates to motor vehicle control.
  • If you are under age 25, you must complete a driving safety course as a condition of deferred disposition.
  • If you are under 25 and hold a provisional license, you must complete a driving safety course and be examined by the Department of Public Safety as a condition of deferred disposition. ​

How Do I Request Deferred Disposition?

If you would like to request Deferred Disposition you must do the following:

1. Make your request for deferred disposition either in person, or in writing, or online before your appearance date.

2. Pay a special expense fee and court costs (the total equals the amount of the fine and court costs) on the day the deferred disposition is granted. ​

What are the Conditions of Deferred Disposition?

Once the judge has granted your deferred disposition request, you will be placed on a probationary period, usually 90 days, and you must not receive another citation during that time. Other conditions may be imposed that you will be made aware of, if applicable.

If your case is for a traffic violation:

  1. if you are under 25 years of age, a Driving Safety Course (DSC) must be taken as a condition;

  2. if you have a provisional driver’s license (under age 18), examination by the Department of Public Safety (DPS) is a condition. 

What Do I Do At the End of the Deferred Period?

Upon successful completion of the deferred period and timely return of all required documents, the violation will be dismissed. ​
